On November 5, 2026, the U.S. Department of Commerce’s Bureau of Industry and Security (BIS) released a final rule extending the suspension of its “Affiliates Rule” — the expanded end-user export control covering affiliates of listed parties — through January 10, 2027. The rule is due to be published in the Federal Register on November 9, 2026, according to BIS and trade-law reporting by Lexology and Kharon.
The Affiliates Rule, issued as an interim final rule on September 29, 2025, would automatically extend Entity List, Military End-User List and certain sanctions-based licensing requirements to foreign entities owned 50% or more, directly or indirectly, by listed parties. BIS suspended the rule for one year from November 10, 2025, and it had been set to return on November 10, 2026. The November 5 final rule extends that suspension by two months. The rule is suspended, not withdrawn.
What this means for buyers
No new ownership-based screening takes effect on November 10: shipments of AMD Xilinx FPGAs continue under the existing end-user screening for now, and buyers do not face a new 50%-ownership test on orders placed today.
The pause is temporary. The rule remains on the books and could return on January 10, 2027 unless it is extended again, so buyers with long-running programs should use this window to confirm end-user and ownership details for their supply chain.
